1. Eligibility and Account Responsibility

Any attempt to sell, lease, or give away an account to others is strictly forbidden and may result in termination of the account.

Account Security: You agree to notify us immediately at support@thefundedpick.com if you suspect any unauthorized access to or use of your account. TheFundedPick reserves the right to suspend or terminate accounts it deems to be compromised, or that are suspected of fraud, misuse, or non-compliance with these Terms .

Account Suspension/Termination: TheFundedPick may suspend or terminate your account at any time if you violate these Terms or engage in any behavior that is fraudulent, abusive, or otherwise harmful to the Site or other users. In such cases, TheFundedPick is not responsible for any loss of data or access to the Service resulting from the suspension or termination.

2. Service Description – Funded Betting Accounts

TheFundedPick Service: TheFundedPick provides a skill-based sports picking evaluation platform designed for users who want to demonstrate their sports betting strategies in order to potentially manage a “funded account.” Our service allows you to enter simulated sports betting challenges (or evaluations) where you place virtual wagers under real-market conditions. If you successfully meet all predefined performance criteria of the challenge (such as profit targets and risk management rules), you can earn the opportunity to operate a funded betting account backed by TheFundedPick’s capital. This enables you to place real wagers with firm capital and share in the profits, without risking your own money.

No Real Gambling or Investment Services: TheFundedPick is not a sportsbook, casino, or gambling operator, and we do not accept or facilitate real-money wagers on our platform. All activities on TheFundedPick during the evaluation phases are conducted with virtual currency (e.g., “profit points”) in a simulated environment that uses real-time sports odds for realism. No actual bets are placed through TheFundedPick – our platform is strictly for evaluation and educational purposes. As such, TheFundedPick is not regulated as a gambling service, and no gaming/betting license is required to offer our challenges. Participation in a TheFundedPick challenge does not involve any investment advice or financial trading services. We do not provide any recommendations on how you should bet or invest; all decisions in the challenges are made by you as a test of your skill.

Educational and Entertainment Purpose: All information, content, and services provided by TheFundedPick are intended for educational and entertainment purposes only. Nothing on our Site constitutes a guarantee of future success in sports betting or any promise of financial gain. TheFundedPick challenges are meant to evaluate your sports picking ability under simulated conditions and are not an offer to participate in real betting markets on our platform. You acknowledge that any success in our simulated challenges does not guarantee success in actual real-money sports betting, which comes with its own risks.

3. Purchases, Fees, and Access to Services

Challenge Fees and Account Access: To access TheFundedPick’s core services (including participation in evaluation challenges and use of the dashboard), you are required to purchase an evaluation account or challenge. Access is granted only to paying users – a one-time challenge fee (or account purchase fee) must be paid to enter a challenge and receive your account credentials . Once your payment is successfully processed, TheFundedPick will provide you with login credentials to access your dashboard and begin the evaluation. By purchasing a challenge, you gain entry to our simulated trading environment where you can start placing virtual picks according to the challenge rules.

No Subscription Obligation: TheFundedPick’s standard model operates on one-time fees for individual challenges. Unless explicitly stated for a specific product, there are no recurring subscription charges. Each challenge fee covers a single evaluation phase or set of phases as described in the plan you select. We reserve the right to introduce new plans or subscription services in the future, but such changes will be clearly communicated and subject to these Terms.

Account Activation: Your evaluation period begins immediately once you receive your account credentials or as otherwise specified (for example, some challenges may allow a flexible start). It is your responsibility to start using the account promptly. If you encounter any issues with accessing your account after purchase, you must contact us immediately. Failure to commence the challenge or utilize the account within any specified time frame may result in account expiration without refund (see Refund Policy below).

Upgrade/Downgrade of Services: TheFundedPick may offer different tiers of evaluation accounts (e.g., varying account sizes or challenge difficulties). If you wish to upgrade or change your plan after purchase, please contact support – such changes may require additional fees and are at TheFundedPick’s discretion. Downgrades (switching to a lower-tier challenge) after purchase are generally not permitted, as each challenge fee is tied to a specific evaluation package.

Access to Dashboard: The dashboard and any software, models, or tools provided by TheFundedPick are for use only by the account holder who paid for the service. You must not share your dashboard login or any proprietary tool access with others. All platform features, including real-time odds, analytics, and support resources, are provided for your individual use as part of the challenge.

4. Payment Terms and Refund Policy

Payment Processing: All payments for TheFundedPick services (challenge fees, evaluation account fees, or other charges) are handled through our approved payment processors. By providing payment information, you represent that you are authorized to use the payment method and you authorize us (or our third-party payment providers) to charge the applicable fee to that method. Prices and available payment methods are displayed at checkout and are subject to change. TheFundedPick reserves the right to adjust pricing for any future challenges or promotions at our discretion.

No Refunds – Digital Product: All sales are final. TheFundedPick provides digital goods and immediate access to services; therefore, payments for our services are non-refundable under almost all circumstances . By purchasing an evaluation challenge or any digital product from TheFundedPick, you explicitly waive your right to request a refund . We do not offer returns, refunds, or exchanges of challenge fees, including cases of user dissatisfaction or failure to complete the challenge, because the service is delivered in full upon purchase (access to the platform and intellectual property is granted, which cannot be “returned”).

Exceptions: The only exceptions to the no-refund policy are those required by law. If applicable law (for instance, certain consumer protection regulations) mandates a cooling-off period or refund in specific situations, TheFundedPick will honor the minimum requirements of such laws. However, to the fullest extent permitted, we treat the service as begun once access is provided, which may limit statutory refund rights (e.g., if you have started using the service, any right of withdrawal may be deemed waived). It is your responsibility to understand any legal rights you have; nothing in these Terms seeks to unlawfully restrict your statutory rights.

Chargebacks and Payment Disputes: Initiating a chargeback or dispute with your bank or card issuer for a legitimate charge is considered a violation of these Terms. If you have an issue with billing, you agree to first contact TheFundedPick support to seek a resolution. Any chargeback, payment reversal, or fraud alert that we receive related to your payment may result in immediate suspension of your account while the matter is investigated . TheFundedPick reserves the right to terminate your account permanently in case of an unfounded chargeback or payment fraud, and any outstanding amounts owed by you (for services already provided) will become immediately due.

Non-Transferable Purchases: Payments are tied to your user account and challenge. You may not transfer a purchased challenge or account to another person. Likewise, any “reward” or funded account you earn upon successful completion of a challenge is personal to you and cannot be sold or transferred. Any attempt to subvert this (such as “selling” a funded account slot to another person) is prohibited and will be void – the account will be terminated and no refund given.

5. User Conduct and Prohibited Activities

When using TheFundedPick, you agree to conduct yourself lawfully, ethically, and in accordance with these Terms. Users may NOT engage in any of the following prohibited activities on our platform :

Illegal or Fraudulent Use: Do not use TheFundedPick for any unlawful purposes, including (but not limited to) money laundering, fraud, or other criminal activities . You may not use the platform to facilitate or promote illegal gambling operations or any activity that violates local, state, national, or international law.

Exploiting the Platform: Do not exploit any software bugs, vulnerabilities, loopholes, or glitches you might discover on the Site. Similarly, the use of automated scripts, bots, crawlers, or other unauthorized software to interact with TheFundedPick is strictly forbidden . All actions on the platform must be initiated manually by a human user through the provided interface.

Market Manipulation: You must not attempt to manipulate sports betting markets or odds through TheFundedPick . This includes any behavior aimed at distorting the outcome of sports events or undermining the fairness of the odds feed used in our evaluations. Our platform’s simulated picks use real-world data; any attempt to interfere with the integrity of that data or the underlying sports events is prohibited.

Account Sharing or Transfer: Your TheFundedPick account is personal to you. You may not share, rent, sublicense, transfer, or sell your account or login credentials to any other party . Likewise, you may not access an account that is not yours or that you are not authorized to use. If we detect account sharing or unauthorized access, we reserve the right to terminate the account.

Violations of Law or Standards: Do not use our Site in any manner that violates any applicable laws, regulations, or industry standards (including sports integrity rules) . You are solely responsible for ensuring that your use of TheFundedPick is compliant with all laws in your jurisdiction (for example, if sports betting simulations are not allowed in your region, you must not use our service).

While our challenges are simulated, actions like sharing insider information, coordinating bets in real markets based on challenge activity, or any form of market abuse using information from our platform, are not allowed.

Violation of any of the above Prohibited Activities is considered a serious breach of these Terms. TheFundedPick reserves the right to take immediate action in such cases, including terminating your account without notice or compensation and, if appropriate, reporting your activities to law enforcement or relevant authorities . You may also be subject to legal action and liable for any damages suffered by TheFundedPick or third parties due to your misconduct.

6. Fraud Prevention and Risk Management

TheFundedPick takes fraud prevention and the integrity of our platform very seriously. By using our Service, you acknowledge and agree that TheFundedPick has the right to implement measures to detect and prevent fraudulent or unauthorized activities . Such measures include, but are not limited to:

No Compensation for Fraudulent Accounts: If your account is terminated or restricted due to fraud suspicion or violation of these Terms, TheFundedPick is under no obligation to compensate you for any lost opportunities or remaining challenge access. For example, if you paid for a challenge and are banned for misconduct before completing it, you will not receive a refund or any other remedy, as such termination is a direct result of your breach of contract.

Collaboration with Other Platforms: In order to safeguard the industry, TheFundedPick may share information about confirmed fraudulent users (such as usernames, user IDs, or patterns of behavior) with affiliated platforms or partner services to prevent wrongdoers from exploiting similar services elsewhere. This is done in accordance with data protection laws and aims to uphold a fair community across the sports funding and trading industry.

By using TheFundedPick, you agree to cooperate fully with any fraud investigation by TheFundedPick. This may include responding to inquiries in a timely manner and providing truthful information. We appreciate honest users and strive to keep the platform safe and fair for everyone.

7. Restricted Uses of the Site

In addition to the specific prohibitions outlined above, you are prohibited from using the Site or its content in any manner that falls into the following categories :

Unlawful Purposes: You must not use TheFundedPick for any illegal purpose or to further any illegal activity . This includes, but is not limited to, actions like attempting to circumvent gambling laws, committing fraud, or engaging in criminal conduct via our platform.

For example, placing coordinated bets on opposite sides of the same game using different accounts (either yours or in collaboration with other users) is strictly forbidden. Any sign of coordinated betting to guarantee a certain outcome or to minimize risk across accounts is considered cheating.

Circumventing Platform Rules: Any transaction or activity that violates TheFundedPick’s platform rules or terms of use is not allowed . This is a broad category that includes exploiting any aspect of the challenge not intended by TheFundedPick, such as using external agreements to share profits or losses, or any kind of arrangement that undermines the individual nature of the challenge.

Automated or High-Frequency Abuse: The use of any technology such as artificial intelligence (AI) agents, high-speed trading algorithms, scripts, or bulk data entry tools to place picks or manage your account in a way that an ordinary user could not is prohibited . All picks must be placed manually by you through our interface. Any attempt to automate bet placement or rapidly open/close positions to exploit system latency or weaknesses will result in disqualification.

Violating Risk Management Rules: Each challenge comes with strict risk management rules (e.g., maximum daily loss, maximum total drawdown, profit target timelines, etc.). Noncompliance with these risk rules or profit objectives (for example, exceeding the allowed loss limits or not meeting profit targets within allowed time) is considered a failure of the challenge, and doing so intentionally to probe system limits is prohibited . You must abide by the specific challenge rules at all times; trying to find loopholes or technicalities in the rules will be viewed as a violation.

Copying Strategies (Cheating): You are not allowed to copy other participants’ betting strategies in a coordinated manner or use mirror trading techniques to duplicate another user’s picks simultaneously . While inspiration and learning are part of any trading or betting environment, setting up arrangements where one or more users mimic the bets of another in real-time to gain an unfair advantage defeats the purpose of evaluating individual skill.

One-Sided Betting Patterns: Engaging in unilateral betting strategies intended to exploit the evaluation criteria is forbidden . For instance, placing bets only in one direction (only on favorites, or only on underdogs, or only wins, only losses, etc.) or deliberately losing bets to reset or exploit some feature of the challenge is not permitted. All picks should be made in pursuit of the challenge objectives, not to exploit the mechanics of the challenge.

Group Coverage Schemes: You must not participate in any group or syndicate that attempts “coverage” of all possible outcomes across multiple accounts . This means a coordinated effort where a group of users jointly ensures that between them they bet on every possible outcome of an event (thereby guaranteeing that at least one account wins). Such schemes, whether conducted entirely on TheFundedPick or across multiple platforms, are strictly disallowed.

Bypassing Security – Emulators & VPNs: Using tools such as device emulators, VPNs/proxies (except for legitimate privacy use), or other methods to bypass TheFundedPick’s security measures or geographical restrictions is not allowed . If, for example, TheFundedPick’s systems are designed to enforce certain limits or detect certain behaviors, you should not attempt to disguise your identity or simulate multiple devices to get around those safeguards.

Any unauthorized wagering practices as defined above will result in immediate action by TheFundedPick. Consequences may include automatic failure of your current challenge, forfeiture of any fees paid, disqualification from receiving any funded account or rewards, and permanent account termination. TheFundedPick reserves the right to invalidate results or revoke funded accounts if we determine they were earned by violating these rules. We may also publicize severe cases (without revealing personal details) to educate users about improper practices.

We are committed to a fair playing field. If you become aware of any user engaging in the above practices, we encourage you to report it to us at support@thefundedpick.com. Whistleblowers who report confirmed cheating may be rewarded or recognized at our discretion.

9. Intellectual Property Rights

All content and materials on TheFundedPick website and services – including but not limited to text, logos, graphics, images, software, and design elements – are the intellectual property of TheFundedPick (VMG Solutions) or its licensors, and are protected by copyright, trademark, and other applicable intellectual property laws . The compilation of all Site content is the exclusive property of TheFundedPick.

By using the Site, TheFundedPick grants you a limited, non-exclusive, non-transferable, revocable license to access and make personal, non-commercial use of the content on the Site . This license is solely for the purpose of using the Service as intended (i.e., participating in challenges and viewing information). No other use of the content or software is permitted without prior written permission from TheFundedPick or the respective rights holder.

Prohibited actions include (but are not limited to) the following, unless expressly authorized by us:

• Your failure to successfully complete an evaluation challenge or the revocation of a funded account due to rule violations.
• Any decision you make based on information obtained through our Site (including decisions you make in real-world betting or trading activities outside TheFundedPick).
• Suspension or termination of your account in accordance with these Terms.
• Any downtime, server errors, data loss, or service interruptions that may affect your ability to use the Service or place picks at any given time .
• Events beyond our reasonable control, including acts of God, power outages, cyber-attacks, war, civil disturbances, or governmental actions.

Cap on Liability: In all cases, TheFundedPick’s total aggregate liability for any claim arising under these Terms or relating to the Service is limited to the amount you paid to TheFundedPick for the service in the 6 months preceding the event giving rise to the liability . For example, if you paid a single challenge fee of €100 and no other fees in the last 6 months, our maximum liability to you for any claim will be €100. If you have paid nothing (e.g., using a free trial), our liability is €0. This limitation applies whether the claim is based on warranty, contract, tort (including negligence), strict liability, or any other legal theory.

User Responsibility: You acknowledge that TheFundedPick has offered its services and entered into these Terms in reliance upon the disclaimers and limitations of liability stated herein, which reflect an agreed allocation of risk between you and us. You further acknowledge that this allocation of risk is a fundamental element of the basis of the bargain between you and TheFundedPick. In plain terms, the fees charged for our challenges would need to be substantially higher if we were to assume more liability.

Because some jurisdictions do not allow certain limitations of liability, some of the above limitations may not apply to you. In such jurisdictions, TheFundedPick’s liability will be limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless TheFundedPick (VMG Solutions) and its parent, affiliates, partners, officers, directors, agents, employees, and representatives from and against any and all claims, demands, causes of action, liabilities, losses, or expenses (including reasonable attorneys’ fees and costs) arising out of or related to: (a) your use of the Site or Service; (b) your breach of any provision of these Terms; (c) your violation of any law or regulation or the rights of any third party; or (d) content or information that you submit, post, or transmit through the Service. This indemnification obligation survives the termination of your account or these Terms .

TheFundedPick reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate fully with our defense of such claim. 13. Account Termination and Suspension
